Revolving door

P.K. Pujari

IAS 1981, Gujarat cadre (retired Union Power Secretary)

789days after leaving Chairperson, Central Electricity Regulatory Commission (CERC). Then Adani Ports and Special Economic Zone Ltd.

The cooling-off rule

CERC term end 11 Jun 2022 to APSEZ appointment 8 Aug 2024

The rule: Electricity Act 2003 s.89(5): a CERC Chairperson or Member may not accept commercial employment for two years after leaving office; 'commercial employment' is defined by reference to organisations that were parties to proceedings before the Commission. AIS (DCRB) rule 26 (one year) applied at his 2017 superannuation from the IAS.

The gap exceeds the two-year bar in s.89(5). APSEZ is a group company of Adani Power, not itself a party in the orders listed; whether s.89(5) reaches group companies is a legal question we have not resolved. Permission: none required after two years; no record found.
